Deed of Gift

On August 22, 1773, Adam Wiseant of Tryon County, North Carolina, of the one part conveyed to Philip Wisenant and his children of the other part. The said Adam Wisenant for and in consideration of his good will, have made a gift unto his children of 100 acres and confirm unto the said Philip Wisenant my son during his life time and after his decease it shall belong and remain to the said Philip's children. The land was on the branches of Indian Creek that empties into Leonard's Fork, joining Haspill's survey. Beginning on Adam Wisenant's third corner. It contained 100 acres and was granted to William Moore on November 16, 1764.

Will

Recorded in Lincoln Co., NC, book 2, pg. 240 dated 11 Jan 1784.

In the name of God Amen. I Adam Whisenhunt, of Lincoln County, and Province of North Carolina, planter, being very sick and weak of body, but of perfect mind and memory, thanks be to God: calling into mind the mortality of my body and knowing that it is appointed for all men to die, do make and ordain this my last will and testament. That is to say principally and first of all I give and recommend my soul into the hands of the Almighty God that gave it, and my body recommend to the earth, to be buried in decent Christian burial at the discreation of my executors. Nothing doubting but at the General Ressurection I shall receive the same again by the Power of God: and as touching such worldly estate wherewith it is pleased God to bless me in this life I give and devise and dispose of the same in the following manner and form: First - I give and bequeath to Barbara my dearly beloved wife, all my lands and the stove and ------- and -------, I leave my wife the one third part of my estate and when she dies, then the land falls to my children to be sold in the best advantage and to be equally divided among all my children and what remains over, when the above is paid of my estate is to be sold and equally divided among all my children both boys and daughters and I do hereby appoint John Askegter, Peter Eaker, Michael Eaker, the executors of this my last will and testament. All and singular my lands, messages and tenements by them fully to be disposed and enjoyes and do hereby utterly disallow, revoke and dis---- all and every other former testament, will legacies and executors, by me and any will before named, willed and bequeathed: ratefying and confirming this and no other to be my last will and testament. I witness whereof, I have hereunto set my hand and seal, this the 11th day of January in the year of our Lord 1784.

Settlement of Will
occurrence: 21 Mar 1801

Settlement of estate of Adam Whisanant. March 21st 1801. It appears to us from the tenor of said will that we the subscribers cannot take into consideration any part mentioned or set forth in the will except that which relates to the lands the widow Barbara being insolvent, the sale of the lands made on the 10th day of Jan. 1801 and the year 1800 thereabouts amounts to the sum of 158 pounds fifteen shillings which is to be divided between eight legatees to wit George M. Whisenhunt, Phillip Whisenhunt, Nicholas Whisenhunt, Margaret Whisenhunt now wife of John Seagel, Eve Whisenhunt, alias (?) Hoffsteller alias Short, John G. Whisenhunt, Barbara Whisenhunt, first wife of Anthony Harmon afterwards wife of Leonard Haines, Catherine Whisenhunt, first wife of Valentine Warlock afterwards to John Anthony which by the will is to be equally divided with and allowing the vouchers may and is herein mentioned.
